Throughout these Terms & Conditions, “we”, “us” and “our” refer to Ink and Fred. “You” and “your” refer to the customer or visitor using our website.
By using our website or placing an order with us, you agree to these Terms & Conditions.
These Terms & Conditions should be read alongside our Returns & Refunds Policy, Delivery Information and Privacy Policy.
2. Our Products
We sell greeting cards and related printed products through our website.
We make every effort to ensure that product descriptions, photographs, colours and other information displayed on our website are accurate. However, colours may appear slightly different depending on your screen or device.
Our products are subject to availability. If an item becomes unavailable after you have placed an order, we will contact you as soon as possible and provide an appropriate refund where necessary.
We reserve the right to discontinue products or make changes to our product range.
3. Personalised Products
Some of our products can be personalised according to the information you provide when placing your order.
You are responsible for ensuring that all personalisation details, including names, dates and messages, are correct before submitting your order.
We will reproduce the information provided by you as accurately as possible. We are not responsible for errors caused by incorrect information supplied by the customer.
Because personalised products are made specifically to your requirements, they are generally not eligible for cancellation simply because you have changed your mind.
This does not affect your statutory rights if a personalised product is faulty, damaged, incorrect or does not match its description.
4. Placing an Order
When you place an order through our website, you are making an offer to purchase the products selected.
After placing your order, you will receive an order confirmation by email. This confirms that we have received your order but does not necessarily mean that your order has been accepted.
Your order is accepted when we confirm that it has been processed for fulfilment.
We reserve the right to cancel an order in circumstances where, for example, a product is unavailable, there is an obvious pricing or product description error, or we are unable to fulfil the order.
If we cancel an order after payment has been taken, you will receive a full refund.
5. Prices and Payment
All prices displayed on our website are in British pounds (£) and include VAT where applicable.
We reserve the right to change our prices at any time. Price changes will not affect orders that have already been accepted.
Payment must be made at the time of placing your order using the payment methods available at checkout.
We use Shopify's secure payment infrastructure and appropriate payment providers to process transactions. We do not have access to your full payment card details.
6. Delivery
We aim to dispatch orders within the processing time stated on the relevant product page or at checkout.
Estimated delivery times are provided as guidance and are not guaranteed unless a specific guaranteed delivery service has been purchased.
Once your order has been dispatched, delivery times are outside our direct control and may be affected by postal delays, customs processing or other circumstances beyond our reasonable control.
For full information about delivery options and estimated delivery times, please see our Delivery Information page.
If your order does not arrive within the expected delivery period, please contact us and we will do our best to assist.
7. Returns and Refunds
Our Returns & Refunds Policy explains your rights and our procedures for returning products and receiving refunds.
For non-personalised products purchased online, you generally have a statutory right to cancel your order within 14 days of receiving your goods, followed by a further 14 days to return them.
Personalised products are excluded from the statutory cancellation right where they have been made to your specific requirements, unless they are faulty, damaged, incorrect or otherwise do not conform to the contract.
Nothing in our Returns & Refunds Policy or these Terms & Conditions affects your statutory rights.
Please see our Returns & Refunds Policy for full details.
8. Faulty, Damaged or Incorrect Products
We take care to ensure that every order is checked and securely packaged before dispatch.
If your order arrives damaged, faulty, incorrect or does not match its description, please contact us as soon as possible with your order number and, where appropriate, photographs showing the issue.
We will assess the problem and provide an appropriate remedy in accordance with your statutory rights.
9. Intellectual Property
All content on this website, including but not limited to designs, illustrations, photographs, graphics, logos, product images, text and branding, belongs to Ink and Fred or is used with permission.
You may not copy, reproduce, distribute, modify, sell or commercially exploit any of our designs, artwork, photographs, product images or other content without our prior written permission.
Purchasing a product from us does not give you ownership of the underlying artwork, design or intellectual property.
10. Website Use
You agree to use our website only for lawful purposes.
You must not knowingly introduce viruses, malware or other harmful material, attempt to gain unauthorised access to our website or systems, or interfere with the normal operation or security of the website.
We reserve the right to restrict or suspend access to our website where we reasonably believe it is being used unlawfully, fraudulently or in a way that may harm our business, website or other users.
11. Website Information
We make reasonable efforts to keep the information on our website accurate and up to date.
However, we do not guarantee that every piece of information will always be complete, accurate or current. We may correct errors or update information when necessary.
Nothing in these Terms & Conditions excludes or limits any liability or responsibility that we cannot legally exclude or limit under UK law.
12. Website Availability
We aim to keep our website available and operating correctly, but we cannot guarantee that it will always be available, uninterrupted or free from errors.
We may occasionally need to suspend access to the website for maintenance, updates or other operational reasons.
13. Links to Other Websites
Our website may occasionally contain links to third-party websites or services.
These links are provided for convenience. We are not responsible for the content, availability, privacy practices or policies of third-party websites.
14. Our Liability
Nothing in these Terms & Conditions affects your legal rights as a consumer.
We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to faulty or misdescribed goods.
Subject to the above, we are not responsible for losses that were not reasonably foreseeable at the time the contract was entered into.
15. Events Outside Our Control
We will not be responsible for delays or failures caused by circumstances outside our reasonable control, such as significant postal disruption, strikes, natural disasters, government action, widespread technical failures or other events beyond our reasonable control.
Where such circumstances affect your order, we will do our best to keep you informed and assist where reasonably possible.
This does not affect your statutory rights.
16. Privacy
Any personal information you provide when using our website or placing an order is handled in accordance with our Privacy Policy.
Please see our Privacy Policy for information about how we collect, use and protect your personal information.
17. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, products, website or legal requirements.
The version published on this page will be the current version.
Any changes will not affect rights you have already acquired under an order that has already been accepted.
18. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the UK, you will also benefit from any mandatory consumer protections that apply to you under the laws of the part of the UK in which you live.
Nothing in these Terms & Conditions limits your statutory consumer rights.
